Post-employment restraints enforced
Justin Simpkins, led by Peter Brereton SC, recently appeared in Supreme Court proceedings for Employsure Ltd in its successful enforcement of contractual restraints against two former employees.
The defendant employees both left their employment with Employsure Ltd to work for the second defendant, ELMO Software Ltd. The Court held that ELMO Software was liable as having induced Mr McMurchy to breach his contract with Employsure Ltd and for knowingly assisting Mr McMurchy’s breach of fiduciary duty.
